The Building Societies Act 1965 governs the registration, governance, and operations of building societies in New Zealand. Building societies are mutual financial institutions that may accept deposits and make mortgage loans to members. They are regulated by RBNZ and, where they accept deposits, are subject to the Deposit Takers Act 2023 framework.

The Act covers: registration and constitution, governance (committee of management), member rights, accounts and audit, amalgamation and conversion (to company or registered bank), and winding up. Obligations under the Act apply to the building society entity itself — not to the technology platform it operates on.

This regulation is relevant to the Totara platform where a licensed building society deploys the platform as its core banking and compliance infrastructure. In that context, the platform satisfies the building society's prudential, AML/CFT, consumer, and payments obligations through the same module set used for any deposit-taking institution.
