NZ: Deposit Takers (Related Party Exposures) Standard

Regulator RBNZ
Jurisdiction NZ
Status Draft — not yet in force
Applicability Platform

The DTA Related Party Exposures Standard is a non-core standard under the Deposit Takers Act 2023. It replaces BS8 (Connected Exposures Policy) and sets the requirements for identifying, measuring, and limiting a deposit taker's exposures to related parties, including parent entities, subsidiaries, major shareholders, directors, and their associates.

An exposure draft is expected as part of Tranche 3. The standard takes effect 1 December 2028. Until then, BS8 remains the operative requirement. See nz-bs8.

Compliance register

This register maps every material obligation under the standard to the platform control or institutional process that satisfies it.

Scope legend

Symbol Meaning
🤖 Automated Platform enforces or performs the obligation. Primary control mode is GATE, AUTO, CALC, or ALERT. Human action is not required in the normal case.
📊 Evidenced Platform captures the evidence trail automatically. Human compliance decision sits on top. Primary control mode is LOG.
🏛 Institutional Obligation is met by a process entirely outside the platform — board governance, treasury, legal. Platform may generate evidence inputs but does not own the process.
N/A Obligation does not apply to this deployment configuration.

S1 Identify all related parties using the definitions in the standard — group entities, significant shareholders, directors, and their associates 📊 Evidenced GOV-009 MOD-147 (CALC) — related party status determined from CDD profile and UBO linkage; no manual aggregation required 🔨
S2 Calculate aggregate related party exposures using the prescribed methodology on a continuous basis 🤖 Automated GOV-009 MOD-147 (CALC) — exposures calculated continuously as a percentage of Tier 1 capital; Tier 1 denominator sourced live from MOD-033 🔨

Exposure limits

Ref Obligation Scope Policy Platform controls Build
S3 Ensure no single related party exposure exceeds the individual limit (expected to align with current BS8: 15% of Tier 1 capital) 🤖 Automated GOV-009 MOD-147 (ALERT) — alert generated when any single related party exposure approaches or breaches the regulatory limit, giving the board time to act before a breach occurs 🔨
S4 Ensure aggregate related party exposures do not exceed the total group limit specified in the standard 🤖 Automated GOV-009 MOD-147 (CALC) — aggregate exposure percentage tracked continuously against both individual and aggregate limits 🔨
S5 Transact with related parties on arm's length terms unless otherwise permitted 🏛 Institutional GOV-009 Board credit committee reviews and approves related party transactions above threshold; MOD-147 provides the current exposure position as an input to that decision

Approval and reporting

Ref Obligation Scope Policy Platform controls Build
S6 Obtain board and, where required, RBNZ approval before entering transactions that would breach permitted limits 🏛 Institutional GOV-009 Board/credit committee decision is institutional; MOD-147 provides exposure data and pre-breach alerts as board inputs
S7 Disclose related party exposures in periodic disclosure statements 🤖 Automated GOV-009 MOD-036 (AUTO) — prudential return builder populates related party exposure disclosures from MOD-147 output 🔨
S8 Report related party positions to the RBNZ on the prescribed schedule 🤖 Automated GOV-009 MOD-036 (AUTO) — regulatory return compiled and submitted automatically on schedule 🔨
